Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hyranse platform and services ("Service"), operated by Artashes Stepanyan Individual Entrepreneur (trading as Hyranse) ("we", "our", or "us"), available at https://hyranse.com/. In these Terms, "you" and "your" refer to any user who accesses or uses the Service and agrees to be bound by these Terms.

By registering for or using the Service, you agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and our Acceptable Use Policy. If you do not agree, you must not use the Service.

1. Eligibility

By using the Service, you represent that:

• You are at least 18 years of age;
• You have the legal capacity to enter into binding agreements;
• You are using the Service for legitimate professional recruitment purposes only;
• Your use of the Service complies with all applicable laws and regulations in your jurisdiction.

2. Description of the Service

Hyranse is a candidate sourcing platform that enables recruiting and hiring professionals to discover and review potential candidates for open roles. The Service aggregates publicly available professional information to help users identify qualified candidates.

The Service is used in the pre-application discovery phase of recruitment. It includes filter-based candidate search, AI-assisted search that suggests profiles matching job descriptions, in-app contact lookup, projects and export tools (as available on your plan), and programmatic access through our REST API and MCP integration.

AI-assisted search results are indicative and for recruiter review only. You must review profiles and decide whether to contact a candidate. Output does not constitute a recommendation, decision, or determination of any kind, including with respect to any employment, hiring, staffing, or human resources decision. You must not use Output as the sole or determinative basis for any employment-related decision, including hiring, rejection, promotion, or compensation, without independent human review and evaluation. Hyranse does not automatically contact candidates on your behalf. You are responsible for your recruitment activities and for ensuring your use complies with applicable law.

We never resell or redistribute professional profile data as a standalone dataset, marketing list, or data-broker product. Access through the Service is limited to authenticated customers under contract for recruitment use only.

The Service is intended solely for professional recruitment use. Any other use — including but not limited to personal investigation, marketing unrelated to hiring, or data resale — is strictly prohibited. See our Acceptable Use Policy for detailed rules.

Contact lookup and export features may be used only for legitimate recruitment outreach regarding specific open positions. Mass outreach, marketing campaigns, cold sales prospecting, and building contact lists unrelated to hiring are expressly prohibited.

3. Account Registration

To access paid features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration;
• Keep your account credentials secure and confidential;
• Notify us immediately of any unauthorised access to your account;
• Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms and our Acceptable Use Policy. You must not:

• Use the Service for any purpose other than legitimate professional recruitment;
• Resell, redistribute, sublicense, or share access to the Service or its data with third parties;
• Scrape, copy, or systematically download candidate data beyond your permitted usage;
• Use the Service to harass, discriminate against, or unlawfully contact any individual;
• Attempt to reverse-engineer, disassemble, or interfere with the Service's infrastructure;
• Use automated tools, bots, or scripts to access the Service beyond normal use, except through our documented REST API or MCP within your plan limits and Acceptable Use Policy;
• Violate any applicable data protection laws, including the UK GDPR and EU GDPR, when processing candidate information obtained through the Service.

Hiring decisions

Hyranse is a search and review tool. It does not make hiring or employment decisions. Search results, rankings and match information are suggestions that help the Customer's recruiters review public professional profiles. The Customer's personnel review every profile and make all hiring and employment decisions, and the Customer is solely responsible for those decisions and for complying with applicable employment, anti-discrimination and data protection laws. The Customer must not use the Service to make decisions about individuals based solely on automated processing.

5. Data Protection Obligations

When you access candidate information through the Service, you act as an independent data controller in respect of your recruitment activities. We act as an independent data controller for the collection, organisation, and maintenance of the professional profile search index, as described in our Privacy Policy and Transparency Notice.

You are responsible for:

• Ensuring your use of candidate data complies with applicable data protection laws, including the UK GDPR and EU GDPR;
• Establishing a lawful basis for any further processing of candidate information, including outreach;
• Providing Article 14 privacy information to candidates where required;
• Responding to any data subject requests from candidates you have contacted;
• Not retaining candidate data beyond your legitimate recruitment need.

5.1 Professional Profile Search Index, Deletion, and Suppression

We maintain a professional profile search index as described in our Privacy Policy and Transparency Notice.

When a candidate submits a valid opt-out, deletion, or objection request, we will remove their profile from future Customer searches within a reasonable period (typically within 30 days), subject to legal retention obligations and backup limitations.

We maintain suppression records to prevent re-indexing or re-appearance of suppressed candidate profiles in the Service without justification. If a profile has been validly suppressed or deleted, Customers must not attempt to restore, re-import, or circumvent that suppression using data previously obtained through the Service.

Upon termination of your subscription, we will delete or anonymise Customer account data in accordance with our Privacy Policy, while honouring valid candidate suppression requests that remain in effect.

5.2 Data Processing Agreement and US Privacy Notice

For Customer account and usage data that we process on your behalf, our Data Processing Agreement (DPA) applies and forms part of your agreement with us when you use a registered account.

Professional profile search index data is governed by separate controller roles as described above and in the DPA. If you are a US resident, our US Privacy Notice supplements the Privacy Policy.

6. Pricing and Payment

6.1 Subscription Plans

Access to paid features is provided on a subscription basis. Current pricing plans are described on the Hyranse pricing page. We reserve the right to modify pricing with reasonable notice.

6.2 Payment Processing and Merchant of Record

Payments are processed by a third-party payment provider, which is named on the checkout page and on your receipt. Requests under our 30-day Refund Policy should be sent to support@hyranse.com; approved refunds are returned to your original payment method.

Subscription payments are processed by a third-party payment provider, which is named on the checkout page and on your receipt. Where that provider acts as Merchant of Record, it is the seller of record for the transaction and handles checkout, billing, invoicing, applicable tax, and payment-related customer service. By completing a purchase, you also agree to the provider's buyer terms shown at checkout.

Artashes Stepanyan Individual Entrepreneur does not store your full payment card details. We provide product and account support at support@hyranse.com. Payment, billing, and checkout-related inquiries can also be sent to the payment provider named on your receipt.

6.3 Billing and Renewal

• Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan;
• Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date;
• You are responsible for cancelling your subscription prior to renewal if you do not wish to be charged;
• You may manage or cancel your subscription through your account settings or the payment provider's customer portal, where available.

7. Refund Policy

We offer a 30-day money-back guarantee on your first paid subscription purchase, as described in our Refund Policy. Submit guarantee requests to support@hyranse.com; approved refunds are returned to your original payment method.

8. Intellectual Property

All rights, title, and interest in and to the Service — including software, design, trademarks, and content — are and remain the exclusive property of Artashes Stepanyan Individual Entrepreneur.

The structure, organisation, compilation, search methodology, and arrangement of the professional profile search index constitute proprietary intellectual property of Hyranse and are protected by applicable intellectual property laws.

These Terms do not grant you any ownership rights in the Service.

You retain ownership of any data or content you submit to the Service. By submitting content, you grant us a limited licence to use it solely to provide the Service.

9. Confidentiality

You agree to keep confidential any non-public information about the Service, its technology, or its business that you access in the course of using the Service. This obligation survives termination of your account.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Artashes Stepanyan Individual Entrepreneur disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure;
• Candidate information is complete, accurate, or up to date;
• The Service will meet your specific recruitment requirements.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Artashes Stepanyan Individual Entrepreneur shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

In no event shall our total aggregate liability to you exceed the amount paid by you to Hyranse in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Artashes Stepanyan Individual Entrepreneur and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your use of the Service in violation of these Terms;
• Your violation of any applicable law or regulation;
• Your infringement of any third-party rights.

13. Termination

Either party may terminate the agreement governed by these Terms at any time.

You may cancel your account at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to the Service until that date, unless otherwise stated at checkout.

We may suspend or terminate your access immediately and without notice if you breach these Terms, engage in fraudulent activity, or if required by law.

Upon termination, your right to access the Service ceases. Provisions that by their nature should survive (including Sections 8, 9, 11, 12, 14, and 15) shall continue to apply.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Armenia, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Armenia, except where mandatory consumer protection or data protection laws in your country of residence require otherwise. Nothing in these Terms limits your rights under applicable data protection law, including the UK GDPR and EU GDPR.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notice to your registered email address.

Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

16. General

• Entire Agreement — These Terms, together with our Privacy Policy, Refund Policy, Acceptable Use Policy, Cookie Policy, Data Processing Agreement, and US Privacy Notice (where applicable), constitute the entire agreement between you and Artashes Stepanyan Individual Entrepreneur regarding the Service;
• Severability — If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force;
• No Waiver — Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision;
• Assignment — You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights freely.
